The Town of Shelby Planning Board shall conduct a combined Public Hearing on Wednesday, January 2, 2019 at 6:45 pm at the Shelby Town Hall, 4062 Salt Works Road, Medina, NY, on the Application by Haleigh Clarke for a Special Use Permit and Site Plan Review and Approval pursuant to Section 780 of the Town Zoning Regulations and pursuant to procedures of Article IX and Article X of the Town Zoning Regulations, in the matter of a proposed Riding Stable to be located at 11205 West Shelby Road on Town Parcel Tax Map No. 101.-1-78, which is within an Agricultural/Residential District.  The proposed Action has been classified as an Unlisted Action under SEQRA.

All those having an interest in the Application will be given an opportunity to be heard at the Public Hearing and may also submit comments in writing to the Town of Shelby in care of Bradley Pask, Planning Board Secretary, not later than 12:00 noon on Monday, December 31, 2018.  The application and supporting information may be examined prior to the Public Hearing at the Town Hall during normal business hours.

Western Orleans Comprehensive Plan

Notice is hereby given that the Town of Shelby will hold a public hearing at 6:20 PM on November 1, 2018 at the Shelby Town Hall, 4062 Salt Works Road, Medina, NY 14103. The proposed amendments would affect the text and maps to reflect changing demographics, technologies, new and revised policies, and other concerns since the Plan’s adoption in 1999. The Western Orleans Comprehensive Plan is available for review at the town hall in Shelby, and the Lee-Whedon Library and online at https://bit.ly/WesternOrleans. Comments will be accepted in written form and should be submitted before the public hearing date to the Town of Shelby at 4062. Salt Works Road, Medina, NY 14103.

NOTICE is hereby given that the Annual Preliminary Budget of the Town of Shelby for the fiscal year beginning January 1,2019, has been completed and filed in the Office of the Town Clerk of Shelby at the Town Hall, 4062 Salt Works Road, Medina, New York, where it is available for inspection by any interested persons at all reasonable hours.

FURTHER NOTICE is hereby given that the Town Board of the Town of Shelby will meet and review said Preliminary Budget and hold a Public Hearing at the Town Hall at 6:00 PM on the 1st day ofNovember 2018, and that at such hearing any person may be heard in favor or against the Preliminary Budget as compiled, or for or against items or items therein contained. PURSUANT to Section 113 of the Town Law, the proposed salaries of the following Town Officers are specified as follows:

At a Regular Meeting of the Shelby Town Board held on October 9, 2018, the following Resolution was made by Councilman Bacon and seconded by Councilman Smith:

WHEREAS Deputy Supervisor Schaal has introduced for consideration pursuant to the provisions of the New York Municipal Home Rule Law Town of Shelby Draft Local Law No. A of 2018 entitled A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW 3-C; be it therefore

RESOLVED that the Shelby Town Board shall conduct a public hearing at a regular meeting of the Shelby Town Board on November 1, 2018 at 6:45 p.m. to consider the adoption of said Draft Local Law No. A of 2018, said Local Law to read as follows:

BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF SHELBY AS FOLLOWS:

Section 1. Legislative Intent

It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Shelby pursuant to General Municipal Law §3-c, and to allow the Town of Shelby to adopt a budget for the fiscal year 2019 that requires a real property tax levy in excess of the “tax levy limit”, including taxes levied on behalf of special districts, as defined by General Municipal Law §3-c.

Section 2. Authority

This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the Town Board to override the tax levy limit by the adoption of a local law approved by vote of sixty percent (60%) of the Town Board.

Section 3. Tax Levy Limit Override

The Town Board of the Town of Shelby, County of Orleans, is hereby authorized to adopt a budget for the fiscal year 2019 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law, §3-c.

Section 4. Severability

If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in it separation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5. Effective Date

This local law shall take effect immediately upon filing with the Secretary of State.

and it is further

RESOLVED that the Shelby Town Clerk shall cause notice of such public hearing to be published at least once in the official Town newspaper in accordance with all legal requirements.
